Board of Education Immigration Resolution

A RESOLUTION BY THE BOARD OF EDUCATION OF THE CITY OF DECATUR TO REAFFIRM ITS COMMITMENT TO PROVIDING SAFE ACCESS TO EDUCATION FOR ALL STUDENTS REGARDLESS OF IMMIGRATION STATUS

WHEREAS, City Schools of Decatur (“CSD”) is committed to ensuring that all students feel welcome and have full access to a safe, supportive, disruption-free learning environment and to ensuring equal access to K-12 education regardless of immigration status; and

WHEREAS, consistent with its legal obligations under Plyler v. Doe, 457 U.S. 202 (1982), CSD does not deny children access to education based on their immigration status nor does CSD ask for, collect, or maintain records regarding students’ immigration status; and 

WHEREAS, CSD continues to adhere to Board Policy JBC pertaining to school admissions, which specifies the types of documentation required for lawful enrollment purposes; and 

WHEREAS, CSD is committed to protecting the confidentiality of student records as required by federal and state student privacy laws, including, but not limited to, enrollment documentation, and the unauthorized disclosure of such records is strictly prohibited; and 

WHEREAS, in its continued commitment to the protection of students, CSD adheres to Board Policy KM pertaining to Visitors to School, which prohibits visitors from entering non-public areas of school property without proper authorization; and 

WHEREAS, CSD also follows established procedures for responding to visits from law enforcement agencies, provides guidance to staff for handling the same, and makes every effort to minimize disruptions to the school learning environment that may be caused by visits from law enforcement.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Education of the City of Decatur reaffirms that all CSD students are entitled to a safe and stable learning environment where they can learn free from fear and with the full support of their school district, regardless of immigration status. 

BE IT FURTHER RESOLVED, that harassment based on actual or perceived national origin is strictly prohibited.  

BE IT FURTHER RESOLVED, that, upon request, families and/or students should be informed that CSD counselors are available to discuss the subjects contained in this Resolution. 

BE IT FURTHER RESOLVED, that the Board of Education of the City of Decatur directs the Superintendent to post a copy of this Resolution No. ____ on CSD’s website and make copies available in other languages upon request.
